When Uber started, the insurance requirements and liability coverage varied tremendously since rideshares were not regulated. This left an unorganized mess when it came to figuring out how to bring an Uber insurance claim after a crash involving an Uber driver.
Legal matters are complicated further by the question of whether an Uber driver is an employee of Uber or an independent contractor. (Note that drivers of rideshare services like Uber are generally considered independent contractors in most jurisdictions.)
Finally, the amount of injury protection insurance available varies depending on whether an Uber driver is actively driving a passenger or on “standby” at the time of the crash. Depending on the driver's status, different amounts of insurance coverage will apply.
Generally speaking, if you are hit by an Uber driver that is logged into the Uber app but on “standby,” you will likely NOT have access to Uber’s full insurance coverage. Depending on the circumstances, the insurance in place may only be the driver's personal auto insurance with potentially limited amounts of collision coverage and property damage liability.
If Uber insurance coverage does apply, it is usually limited to up to $50,000 in bodily injury per person, $100,000 in bodily injury per accident, and $25,000 in property damage per accident.
NOTE, however – this situation is not always clear! There are situations when there will be a dispute between insurance companies about coverage. For example, if a driver is on “standby” and causes an accident, the Uber insurance claim could be denied because the driver didn’t have a passenger. On the other hand, the driver’s personal insurance could deny the claim arguing that the driver was using the vehicle for commercial purposes!
In a situation such as this, you will need the assistance of an experienced ride share or Uber car accident lawyer to help sort out liability and make sure that your Uber personal injury claim pays for your medical expenses and that lost wages are accepted and paid.
